These terms apply to consumer use of the InSyncPets website, shop, accounts, personalised products, smart tags, pet profiles, finder pages and digital services. Separate written terms may apply to business, wholesale, white-label or bespoke arrangements.

2. Eligibility and acceptance

You must be at least 18 years old and legally able to enter a contract. By placing an order, buying a subscription or using an account, you agree to these terms and any product, subscription or checkout information presented before purchase.

3. Orders and contract formation

An order confirmation acknowledges that we received the order; it does not necessarily mean the order has been accepted. A contract for physical goods is formed when we confirm acceptance or dispatch. A contract for a digital service or subscription is formed when we confirm the service or activate the paid entitlement. We may reject or cancel an order before acceptance, including for unavailable stock, failed payment, suspected fraud, pricing error or personalisation that cannot reasonably be produced.

4. Product descriptions and personalisation

We take reasonable care to describe products accurately. Colours and dimensions may vary slightly because of screens, materials and manufacturing. Customers must check names, contact details, addresses, dates, wording, images, size, colour and other personalisation before submitting or approving an order. We are not responsible for an error supplied or approved by the customer, but this does not affect rights where the product is faulty, misdescribed or not produced to the agreed specification.

5. Prices and payment

The price shown before order includes VAT where applicable. Delivery and any optional charges are shown before the customer commits to pay. Payment must be authorised by the chosen provider. We do not add undisclosed payment-provider charges.

6. Smart-tag and finder service

InSyncPets smart tags use NFC and QR links to open an owner-controlled digital profile. Operation depends on a readable tag, compatible device, internet access, an active web service and accurate profile information. The service can support identification and contact but does not guarantee that a lost pet will be found or returned.

The account holder chooses which information is visible to a finder and is responsible for keeping that information accurate and appropriate. Visible contact details printed on the physical tag remain subject to the customer-approved artwork and available space.

7. Accounts and other people’s details

You must keep account credentials secure and notify us of suspected unauthorised access. You may only add a trusted contact, emergency contact, family member or veterinary contact where you have a lawful reason to use their details and have told them appropriately.

8. Customer content

You retain ownership of pet images, profile text and other content you provide. You give GYAMDIAS LTD a non-exclusive licence to host, reproduce, resize and display that content only as needed to provide, secure and support the service. You must have the right to upload the content and it must not be unlawful, misleading, abusive or infringe another person’s rights.

9. Delivery

Production and delivery information is provided on the product page, at checkout and in the order confirmation. See our Shipping & Delivery page. Risk in physical goods passes when they are delivered to the customer or a person identified by the customer.

10. Cancellation, returns and faulty goods

Consumer cancellation and return rights, including the exception for clearly personalised goods, are explained in our Returns & Refunds Policy. Nothing in these terms removes statutory rights relating to goods, digital content or services that are faulty, not as described or not provided with reasonable care and skill.

11. Subscriptions

Recurring plans are governed by the Subscription Terms, including billing periods, automatic renewal, cooling-off rights, cancellation, failed payments and the effect of expiry.

12. Acceptable use and suspension

You must not misuse, scrape, attack, reverse engineer, interfere with or gain unauthorised access to the website or service. We may restrict or suspend an account, profile, finder page or tag where reasonably necessary for security, misuse, unlawful content, non-payment or a serious breach. Where appropriate, we will explain the reason and provide a route to challenge the decision.

13. Availability and changes

We aim to provide a reliable service but cannot promise uninterrupted access. Maintenance, network failure, third-party services, phone compatibility, payment systems, hosting and events outside reasonable control may affect availability. We may make proportionate changes for security, legal compliance or product improvement. Material changes affecting a paid service will be notified where required.

14. Liability

Nothing excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, breach of statutory consumer rights, or any liability that cannot lawfully be excluded.

For consumers, we are responsible for loss or damage that is a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, for business losses suffered by a consumer acting mainly for personal purposes, or for loss caused by inaccurate customer information, failure to attach or maintain the tag, loss of internet/device access, or unlawful use by another person, except where the law says otherwise.

15. Complaints

Contact info@insyncpet.com with the order or account reference and details of the issue. We will acknowledge and investigate the complaint within a reasonable time.

16. Governing law

These consumer terms are governed by the law of England and Wales. A consumer living elsewhere in the UK may also rely on mandatory rights and may bring proceedings in the courts available under applicable consumer law. International consumers retain mandatory local rights that cannot be excluded.
